Letters Testamentary to Emma Churchill

Filed this 2nd day of November 1923 and recorded in Book G, Page 282. Clarence H. Tanner, County Clerk.

 

STATE OF ILLINOIS,}

COUNTY OF FULTON,} SS.           In the County Court, October Term A. D. 1923

 

THE PEOPLE OF THE STATE OF ILLINOIS TO ALL TO WHOM THESE PRESENTS SHALL COME—GREETING:

 

KNOW YE THAT WHEREAS Eugene Churchill of the County of Fulton and State of Illinois, died on or about the 8th day of August 1923, as it is said, after having duly made and published his Last Will and Testament, a copy whereof is hereunto annexed, leaving at the time of his death, property in this state which may be lost, destroyed or diminished in value if speedy care be not taken of the same; and inasmuch as it appears that Emma Churchill has been appointed Executrix in and by the Last Will and Testament, to execute the same. 

 

Now, to the end that said property may be preserved for those who shall appear to have a legal right or interest therein; and that the said Will may be executed according to the request of the said Testatrix we do hereby authorize the said Emma Churchill as such Executrix to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said Eugene Churchill at the time of his decease, in whosoever hands or possession the same may be found in this state, and well and truly to perform and fulfill all such duties as may be enjoined upon her by the said Will, so far as there shall be property, and the law charge her; and in general to do and perform all other acts which now are, or hereafter may be required of her by law.

 

WITNESS Clarence H. Tanner Clerk of the said County Court, and the seal of said Court, hereunto affixed at Lewistown, this 2nd day of November A. D. 1923.

EXECUTOR’S BOND

STATE OF ILLINOIS}

FULTON CONTY.} ss.                      IN COUNTY COURT November TERM, 1923

 

KNOW ALL MEN BY THESE PRESENTS, That we Emma Churchill, Dorliska Jenkins, and Marie Churchill of the County of Fulton and State of Illinois, are held and firmly bound unto the People of the State of Illinois, in the penal sum of Five Thousand ($5000) Dollars, current money of the United States, which payment, well and truly to be made and performed, we, and each of us, bind ourselves, our heirs, executors and administrators jointly, severally and firmly by these presents.

 

Witness our hands and seals, this 27th day of October A. D. 1923.

 

THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, That if the above bound Emma Churchill Executrix of the Last Will and Testament of Eugene Churchill, deceased do make or cause to be made a true and perfect inventory of all and singular the goods and chattels, rights and credits, lands, tenements and Hereditaments and the rents and profits issuing out of the  same of the said deceased, which have or shall come to the hands, possession or knowledge of the said Emma Churchill or into the possession of any other person for her, and the same so made do exhibit in the County Court for the said County of Fulton, as required by law, and also make and render a fair and full account of her, and the same so made do exhibit in the County Court for the said County of Fulton, as required by law, and also make and render a fair and full account of her actings and doings as such Executrix to said Court, when thereunto lawfully required and do well and truly fulfill the duties imposed upon her in and by the said Will and shall,  moreover, pay and deliver to the persons entitled thereto all the legacies and bequests contained in said Will so far as the estate of the said Testator will thereunto extend, according to the value thereof, and as the law shall charge her; and shall in general do all other acts which may from time to time be required of her by law; then this obligation to be void.  Otherwise to remain in full force and virtue.
