Editor's Note: Helena J. Churchill was the wife of George S. Churchill, son of Franklin and Finvola Churchill, grandson of Charles Belden Churchill Jr., Great-grandson of Charles Belden Churchill Sr--the first.
I, HELENA J. CHURCHILL, of the City of Canton, County of Fulton, State of Illinois, the widow of George S. Churchill, do hereby make, publish and declare this to be my Last Will and Testament, hereby revoking any and all wills by me at any time heretofore made.
FIRST: I direct that my executors, hereinafter named, pay all of my just debts, funeral expenses and costs of administration of my estate as soon after my death as conveniently may be done.
SECOND: I hereby give, devise and bequeath to the following named persons in recognition of their kindness to myself and my deceased husband, George S. Churchill, during the past years, the following sums:
To CYLE RASH the sum of $5,000.00
To FLORENCE LOUISE SPYRES the sum of $5,000.00
To SUSAN JONES the sum of $1,500.00
In the even that any of the above named legatees are not living at the time of my death, then the legacy to those dying prior to my death shall lapse and become part of my residuary estate.
THIRD: All the rest, residue and remainder of my estate I give, devise and bequeath to my niece, LEOTA J. HEUSTON, to have and to hold the same as her own forever. If she not be living at the time of my decease, I devise said residue in equal shares, to her husband, REV. LESLIE G. HEUSTON, and her son, HARRY G. HEUSTON, or to the survivor of the.
FOURTH: I am fully aware of the fact that I have other relatives not named in this, my Last Will and Testament, which I have omitted for reasons which are sufficient to me.
LASTLY: I hereby nominate and appoint my niece, LEOTA J. HEUSTON, and her husband, REV. LESLIE G. HEUSTON, as Executors of this, my Last Will and Testament, and request that they and each of them be not required to give bond or security, bond and security being hereby expressly waived.
In the event of the death, inability or refusal of the said LEOTA J. HEUSTON or her said husband, REV. LESLIE G. HEUSTON, to act as Executors of this Will, then I hereby nominate and appoint HILTON MERCER of Canton, Illinois, to be Executor of this, my Last Will and Testament, and request that he not be required to give bond or security, bond or security being hereby expressly waived.

WE hereby certify that the foregoing instrument was, on the date hereof, signed, sealed and published and declared by HELENA J. CHURCHILL as and for her Last Will and Testament, in our presence, who, at her request and in her presence and in the presence of each other, have hereunto subscribed our names as witnesses thereto, believing the said HELENA J. CHURCHILL, at the time of so signing, to be of sound mind and memory and under no undue influence.

Your petitioner, LEOTA J. HEUSTON, respectfully states:
1. That Helena J. Churchill, a resident of Canton in the County of Fulton and State of Illinois, died on the 30th day of March, 1963, at Canton, Illinois, leaving a Will duly signed and attested, which your petitioner now presents to your Honor for probate.
2. That the approximate value of the real and personal estate of the testator in this State is as follows:
Personal estate not to exceed in value $100,000.00
Real estate not to exceed in value $ 25,000.00

4. That testator by said Will nominated Executors, LEOTA J. HEUSTON and REV. LESLIE G. HEUSTON, who are non-residents of the State of Illinois and unable to serve; and testator further provided that in such event, HILTON MERCER of Canton, Illinois, serve as such Executor without bond.
5. Wherefore your petitioner prays that said will be admitted to probate and that Letters Testamentary be issued to HILTON MERCER.

CHURCHILL, deceased, who died on the 30th day of March, 1963 and is authorized to sue for and collect the personal estate of and debts due the decedent and to perform all duties imposed on him by the Will so far as there is property and the law charges him; and to do all other acts now or hereafter required of him by law.

FINAL REPORT
TO THE HONORABLE FRANCIS P. MURPHY, ASSOCIATE JUDGE OF SAID COURT:
The undersigned HILTON MERCER, as Executor of the Last Will and Testament of HELENA J. CHURCHILL, deceased, would respectfully report:
1. That Helena J. Churchill died testate on the 30th day of March, 1963, and her Last Will and Testament was duly admitted to probate and record by the County Court of Fulton County, Illinois, on April 29, 1963, by said Court.
2. That an Inventory was duly filed and approved.
3. That adjudication of claims was duly made, and all claims were duly paid, and there is not now pending in this Court, or any Court, on appeal or otherwise, any claim against said estate.
4. That costs of administration have been fully paid.
5. That undersigned has filed a Federal Estate Tax Return and paid the Federal Estate Tax in the amount of $8,898.43, to the Federal Government and said Federal Estate Tax Return has been approved as filed.
6. That Illinois Inheritance taxes have been paid in full, and the Inheritance Tax Return has been approved by this Court; that said inheritance taxes have been allocated to the respective legatees.
7. That, as said Executor, he has paid the specific legacies provided for in the second Clause of said Will, viz:

SUSAN JONES the sum of $1,000.00
8. That, in and by the third clause of said Will, after the payment of debts, funeral expenses, costs of administration, and the specific legacies set forth in Item 7 of this report, decedent gave all the rest, residue and remainder of her estate of LEOTA J.
