Will and Testament of
Leonard Churchill

January 16, 1902

In the name of God amen, I, Leonard H. Churchill of Joshua Township, in the County of Fulton and State of Illinois, being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my Last Will and Testament.

 
First:  I order and direct that my Executors hereinafter named pay all my just debts and funeral expenses as soon after my decease as conveniently may be.
 
Second:  After all payments of such funeral expenses are made I give, devise and bequeath all my Personal and Real Estate to my beloved wife Harriet Churchill while she remains my widow, and to have all proceeds derived off of the farm and income whatsoever; after her living and necessary expenses are paid each year it is my desire and wish that the balance, if any, be equally divided among my children, unless they otherwise may agree among themselves and I also direct that my Executors shall have erected at my grave a suitable monument for myself and wife, to cost no less than Five Hundred Dollars ($500.00).  After the death of my beloved wife it is my wish that the Real Estate and Personal property remaining shall be sold and equally divided among my children or legal heirs, except Thirteen Hundred Dollars ($1300.00) due me from my son Chas. H. Churchill, One Hundred and Ten Dollars ($110.00) due me from John B. and Alexander Churchill and Nine Hundred Dollars ($900.00) due me from J. L. Churchill, all those amounts to be deducted from their shares without interest, otherwise I wish the remainder divided as equally as possible.
 
Lastly:  I make, constitute and appoint my son R. I. Churchill and my son-in-law Lon Ash to be my Executors and to assist my beloved wife in all her business transactions when required of this my Last Will and Testament, hereby revoking all former Wills made by me.
 
In witness whereof I Leonard H. Churchill have to this my Last Will and Testament, consisting of the above papers, subscribed my name and affixed my seal this 16th day of January in the year of my Lord One Thousand Nine Hundred and Two (1902).

Churchill as and for his Last Will and Testament in the presence of us who at his request and in his presence and in the presence of  each other have subscribed our names as witnesses at Cuba, Fulton County, Illinois, this 16th day of January A. D. 1902.
