PETITION TO PROBATE WILL

FULTON COUNTY}ss.  In the Fulton County, County Court

Probate, April, Term, A. D. 1909

To the Hon. John D. Breckenridge Judge of said Court:

 

The undersigned Petitioner Henry Shiery respectfully represents to your Honor that the attached instrument of writing purports to be the Last Will and Testament of L. H. Churchill, deceased.  That the said deceased departed this life at Cuba, Illinois on or about the 28th day of March A. D. 1909 and at the time of his death resided at Cuba in the County of Fulton and the State of Illinois.  Your Petitioner further represents that the said deceased left the following named heirs-at-law and legatees:

 

Wife: Harriet Churchill Cuba, Illinois
Daughter: Mary Elmina Jones Cuba, Ill., R.R.
Son: Chas. H. Churchill Hereford, Texas
Son: Alexander H. Churchill Fiatt, Ill.
Son: John B. Churchill Fiatt, Ill.
Son: R. I. Churchill Fiatt, Ill.
Son: Leonard F. Churchill Fiatt, Ill.
Son: Daniel W. Churchill Fiatt, Ill.
Son: Jerry L. Churchill Cuba, Ill.
Daughter: Dollie B. Ash Canton, Ill.
Daughter: Grace B. Stuckey Fiatt, Ill., R. R.

                         

And that the above named persons are all the heirs-at-law and legatees of L. H. Churchill.  Your Petitioner further asks that the said Last Will and Testament of L. H. Churchill be admitted to probate Henry Shiery.

FULTON COUNTY}ss.         Henry Shiery being duly sworn, deposes and says that the allegations contained in the foregoing petition are true, to the best of his knowledge and belief.

PETITION OF R. I. Churchill and Lon Ash

FOR LETTERS TESTAMENTARY TO THEMSELVES

ESTATE OF L. H. CHURCHILL, Deceased

STATE OF ILLINOIS}

FULTON COUNTY}ss.  IN THE FULTON COUNTY COUNTY COURT

 

IN PROBATE, April Term, A. D. 1909

 

IN THE MATTER OF THE ESTATE OF L. H. CHURCHILL, deceased} PETITION FOR LETTERS TESTAMENTARY.

 

TO THE HON. John D. Breckenridge Judge of said Court.

 

The Petition of the undersigned R. I. Churchill, and Lon Ash respectfully represents that L. H. Churchill late of the County aforesaid, departed this life at Cuba, Illinois, on or about the 28th day of March A. D. 1909, leaving at the time of is death a Last Will and Testament; Probate of said Will and proof thereof having been made together with proof of death, and the names of heirs-at-law and legatees; all of which having been duly entered of record on the 28th day of April A. D. 1909.

 

Your Petitioners further represents that the said L. H. Churchill died seized and possessed of Real and Personal Estate; said Real Estate being estimated to be worth about Thirty Thousand Dollars, and said Personal Estate being estimated to worth about Thirty Five hundred, Dollars.

 

Said Last Will and Testament having named R. I. Churchill and Lon Ash as Executors thereof, who is present, ready and willing to accept and undertake the said office and trust so confided to them.

 

Therefore, May it please Your Honor to grant Letters Testamentary to R. I. Churchill and Lon Ash, who is ready and willing to take the oath prescribed by the statute and enter into bond in such sum and with such securities as may be approved by Your Honor.
