Dear Sir:

 

We enclose petition of will of L. H. Churchill, deceased, which petition you sent to recently for filling out.  If not properly drawn up, return and state corrections made.

 

There are four children of L. H. Churchill, who died in infancy; we give you these names, think you might desire the knowledge; Chancy Churchill, Chester D. Churchill, George Churchill and James Churchill.

 

The executors request that the Will be probated as early as possible, as there are some bills that should be taken care of at once, against the estate.

 

If you will let Mr. F. H. Cole, on of the witnesses of the Will, know the date the witnesses and executors are wanted, he will advise those who are to come down.

FULTON COUNTY,}ss.  IN COUNTY COURT April TERM, 1909

 

KNOW ALL MEN BY THESE PRESENTS, That we Lon Ash as Principal and Len Fisher as Surety of the County of Fulton and State of Illinois, are held and firmly bound unto the People of the State of Illinois, in the penal sum of Seven Thousand Dollars, current money of the United States, which payment, well and truly to be made and performed, we, and each of us, bind ourselves, our heirs, executors and administrators jointly, severally and firmly by these presents.

 

Witness our hands and seals, this 28th day of April A. D. 1909.

 

The Condition of the Above Obligation Is Such, That if the above bounden has been appointed Co-Executor of the Last Will and Testament of L. H. Churchill, deceased, do make or cause to be made a true and perfect inventory of all and singular the goods and chattels, rights and credits, lands, tenements and Hereditaments and the rents and profits issuing out of the same of the said deceased, which have or shall come to the hands, possession or knowledge of the said Lon Ash or into possession of any other person for him, and the same so made do exhibit in the County Court for the said County of Fulton, as required by law, and also make and render a fair and full account of his actings and doings as such Co-Executor to said Court, when thereunto lawfully required, and do well and truly fulfill the duties imposed upon him in and by the said Will and shall, moreover, pay and deliver to the persons entitled thereto all the legacies and bequests contained in said Will so far as the estate of the said Testator will there unto extend, according to the value thereof, and as the law shall charge him; and shall in general do all other acts which may from time to time be required of in by law; then this obligation to be void.  Otherwise to remain in full force and virtue.

Taff, a Notary Public in and for said County, hereby certify that Lon Ash as principal and Len Fisher as surety, who are each personally known to me to be the same persons whose names are subscribed to the foregoing instrument appeared before me this day in person, and acknowledged that they signed, sealed and delivered the said instrument as their free and voluntary act for the uses and purposes therein set forth.

Churchill deceased, so far as I know or believe; and that I will well and truly execute the same, by paying first the debts then the legacies mentioned therein, as far as his goods and chattels will there unto extend and the law charge me; and that I will make a true and perfect inventory of all such goods and chattels, rights and credits, as may come to my hands or knowledge, belonging to the estate of said deceased, and render a fair and just account of my co-executorship when thereunto required by law, to the best of my knowledge and abilities.  So help me god.

LETTERS TESTAMENTARY

STATE OF ILLINOIS}

FULTON COUNTY} ss.        In the County Court, April Term, A. D. 1909

 

The People of the State of Illinois to All to Whom These Presents Shall Come—Greeting:

 

Know Ye That Whereas L. H. Churchill of the County of Fulton and State of Illinois, died on or about the 28th day of March 1909, as it is said, after having duly made and published his last Will and Testament, a copy whereof is hereunto annexed, leaving at the time of his death, property in this state which may be lost, destroyed or diminished in value if speedy care be not taken of the same: and inasmuch as it appears that R. I. Churchill and Lon Ash have been appointed Executors in and by the Last Will and Testament, to execute the same.

 

Now, to the end that said property may be preserved for those who shall appear to have a legal right or interest therein; and that the said Will may be executed according to the request of the said Testator we do hereby authorize the said R. I. Churchill and Lon Ash as such Executors to collect and secure, all and singular the goods and chattels, rights and credits, which were the said L. H. Churchill at the time of his decease, in whosoever hands or possession the same may be found in this state, and well and truly to perform and fulfill all such duties as may be enjoined upon them by the said Will, so far as there shall be property, and the law charge them; and in general to do and perform all other acts which now are, or hereafter may be required of them by law.

 

WITNESS Oscar Horton Clerk of the said County Court, and the seal of said Court hereunto affixed at Lewistown, this 1st day of May A. D. 1909.

In Probate, December Term, A. D. 1912

On this 31st day of Dec. A. D. 1912, personally appears Robert I. Churchill and states to the Court that Harriet Churchill last of said County, departed this life at Cuba, in the County and State aforesaid on or about the 27th day of December A.D. 1912, leaving at the time of her death no husband but left Charles H. Churchill, Mary Elmina Jones, Alexander H. Churchill, John B. Churchill, R. I. Churchill. Leonard F. Churchill, Daniel W. Churchill, Jerry L. Churchill, Dollie B. Ash, Grace B. Stuckey, her children as her only heirs at law.

 

Affiant further states that all of the above mentioned heirs at law are of full age and under do disability.

 

That the said deceased was the surviving widow of Leonard H. Churchill, deceased and that she remained the widow of said deceased until her death.
