Case Dismissed on Grounds “Without Cause”

The case in the justice court Saturday instituted Mrs. W. I. Ray, complainant, against Mrs. A. C. Dempsey charging her with assault on her small daughter was dismissed on the grounds “without cause for action”.

While a number of witnesses were examined there was a failure upon the part of the complainant’s attorney to establish a preponderance of evidence to prove the alleged assault.

In general the evidence gravited about a good-natured snow-balling between the children of the two households that in its primitive state was nothing more than a child scrap soon to be forgotten. It rose to considerable dimensions when the parents carried the matter into local court.

There was evidenced no disposition on the part of the complainant to appeal the case.
