Will of Henry Balster

I, Henry Balster, of the City of Petersburg, in the County of Menard and State of Illinois, being of sound mind and memory, do make, publish and declare this my last will and testament in the manner following, to wit:
First, - I will and direct my executor hereinafter named, shall within one year after my death, sell at public sale all my real estate, whosoever the same may be situated, and convert the same into money, and I also will and direct my said executor hereinafter named, to reduce and convert into cash all my notes, mortgages, bonds, stocks, choses in action and other personal property as soon as possible after my decease. And I hereby give to my executor hereinafter named full power and lawful authority to sell all my real estate and personal property and to execute and deliver all deeds, instruments of transfer and other writings necessary to pass proper title thereto.

Second, - I will and direct that all my just debts and funeral expenses, including costs of administration and executor fees, commissions and expenses shall be fully paid first out of the general fund of my estate.

Third, - I leave to my executor hereinafter named the sum of three hundred dollars, out of the general fund of my estate, to be loaned out by him and the interest arising from the same, to be loaned out by him and the interest arising from the same, after deducting his reasonable charges and expenses, shall be used in caring for my burial lot and monuments thereon in Rose Hill Cemetery in Menard County, Illinois, and upon his death or resignation, I request the Trustees of said Rose Hill Cemetery Association to take charge of said fund and use the same as above directed.

Fourth, - I give and bequeath out of the general fund of my estate the cash sum of two hundred dollars to the Trustees of the German Evangelical Lutheran St. Paul's Congregation of Petersburg, Illinois, to be used by them for the maintenance of their church.

Fifth, - I give and bequeath unto my executor hereinafter named the sum of one thousand dollars in trust for my son John Balster upon the trust hereinafter mentioned.

Sixth, - It is my will that all the balance of my Estate remaining after the payments hereinbefore directed and after the payment and setting aside for investment of the particular legacies and bequests hereinbefore made, be and the same is hereby given and bequeathed on terms and conditions as follows: To my son Benjamin Balster one sixth part thereof; to my son Heinrich Balster one sixth part thereof; to my son Thomas Balster one sixth part thereof; to my daughter Marie Kasten one sixth part thereof; to my son Harmon Balster, his wife Julia Balster, Helen Balster and William Balster, his children, each a one twenty fourth part thereof; and the remaining one sixth part thereof is hereby given to my executor hereinafter named in trust for my said son John Balster.

Seventh, - The foregoing bequests and legacies to my executor hereinafter named in trust for the said John Balster, are to be held by him on the following trusts: To invest such sum or sums as he may receive from time to time in the settlement of my estate in such securities as in his judgment he may deem safe, and to change investments from time to time, and to apply all or an part of the income derived therefrom for the maintenance and personal support of my said son John Balster in such proportions and in such manner as my trustee shall, in his discretion, from time to time think proper. I further will and direct that neither said trust fund not the income derived therefrom shall be subject to the power of assignment or anticipation on the part of my said son, and shall be without liability to execution or attachment by any creditor of the said John Balster. Upon the death of the said John Blaster said trust shall cease and determine and said trust fund and the accumulated income therefrom, if any, shall vest in his surviving brothers and sister and if any of his brother or sister be dead, their share of this part of my estate shall go to their children.

And lastly I hereby nominate and appoint my grand nephew Harry G. Balster sole executor of this my last will and testament, all others being hereby revoked, and also as trustee to carry out the trusts as in his will set forth, and I further will and direct that he shall receive the sum of six hundred dollars and no more for his services as such executor.

This instrument was, on the day of the date thereof, signed, sealed, published and declared by the said testator, Henry Balster, to be his Last Will and Testament, in the presence of us who, at his request, have subscribed our named thereto, as witnesses, in his presence and in the presence of each other.
